SHAC and Jus Mundi Announce a Partnership for Sharing Redacted Publishable Arbitration Awards

The Shanghai Arbitration Commission (SHAC) and Jus Mundi are delighted to announce a new partnership to share redacted SHAC arbitration awards and related SHAC arbitration materials globally, boosting worldwide understanding of Chinese arbitration and for the benefit of the global public good.

Following pseudonymisation or anonymisation, Jus Mundi will host select SHAC redacted arbitration awards and related information on its open public database, allowing anyone in the world to search these materials using Jus Mundi’s open research tools.

Speaking about the partnership, Dr. FAN Mingchao, Executive Vice President of the Shanghai Arbitration Commission, stated that:

“The signing of the agreement will enhance global users’ understanding of Chinese arbitration, improve the worldwide acceptance of Chinese arbitration institutions, increase the trust of global market participants in arbitration as an internationally recognized dispute resolution method, and build up the credibility of Chinese arbitration internationally.”

He continued:

“Meanwhile, the cooperation between SHAC and Jus-Mundi will also help to improve the transparency of arbitration, promote arbitration as the world’s preferred dispute resolution mechanism, and advance the development of international economic and legal systems.”

Jean-Rémi de Maistre, CEO & Co-Founder of Jus Mundi, said:

For this reason, Jus Mundi is delighted to join together with SHAC to bring publishable SHAC arbitration awards into the public domain. The partnership will see select SHAC arbitration awards and related materials hosted on Jus Mundi’s comprehensive international law and arbitration database.


About SHAC

Shanghai Arbitration Commission (SHAC) was established on September 18, 1995. It was one of the first pilot arbitration institutions set up in China. Since its establishment, SHAC has administered more than 50,000 contractual disputes in finance, real estates, construction projects, intellectual property, maritime affairs and commerce, international trades, international agencies, international engineering projects, international investments, international technical cooperation, etc., involving a total amount in dispute of nearly RMB 300 billion.

All administered cases account for about 60% to 70% of the total number of arbitration cases in Shanghai. In 2022, 76.27% of the arbitration cases administered by SHAC had one or both parties from outside Shanghai, which shows that it provides professional and efficient arbitration services to market participants from across China while serving Shanghai’s economic and social development and enhancing the business environment.

上海仲裁委员会(SHAC)与Jus Mundi宣布建立合作关系,在全球范围内共享经脱密编辑的SHAC匿名仲裁裁决和相关资料,增进世界对中国仲裁的了解,并造福全球公共利益。

经过匿名化等技术处理后,Jus Mundi将在其开放的公共数据库中发布精选的经脱密编辑的SHAC匿名仲裁裁决以及相关信息,以使全球任何人都能利用Jus Mundi的开放研究工具进行检索。

在谈到该合作关系时,上海仲裁委员会常务副主任范铭超表示:

“提高全球对中国仲裁机构的认可度,增进全球市场主体对仲裁作为一种国际通行的争议解决方式的信任感,提升中国仲裁的国际公信力。同时,双方的合作将提高仲裁的透明度,推动仲裁成为全球首选的争议解决机制,促进国际经济和法律体系的发展。”

关于上海仲裁委员会

上海仲裁委员会成立于1995年9月18日,是中国首批试点设立的仲裁机构之一。上海仲裁委员目前业务涵盖的领域为:金融、房地产、建设工程、知识产权、海事海商、体育、能源、贸易、国际仲裁、通用航空、公司与投资、其他民商事争议。上海仲裁委员会累计处理各类合同争议案件数量逾5万件、涉案争议金额总计近人民币3000亿元、占上海总体仲裁案件数量逾70%。其中,2022年案件数据如下:案件数量5671件,同比减少5.75%:民商事2042件、建设工程1396件、金融1027件、知识产权440件、房地产387件、公司260件、家庭装潢107件、海事海商7件、中外合资合作5件;争议金额424.51亿元,同比增加21.13%;受理案件平均标的额748.57万元,同比增加28.52%;案件从组庭到结案的平均时间为140.79天,上海仲裁委员会仲裁员名册中共有仲裁员1785人。其中,女性仲裁员464人,占比26%。2022年度,本会指定或者当事人选定的女性仲裁员达1715次,占全年指定或选定仲裁员人次的近24%。
