An Overview of the Law Commission’s Consultation Paper on Reviewing the English Arbitration Act 1996
Much has changed since the English Arbitration Act 1996 (the “Act”) came into force. Nonetheless, the Act has proven broadly successful. This raises the question of whether the Law Commission’s recent consultation paper was needed at all. Indeed, the paper proposes leaving much of the Act untouched. However, it puts forward several notable changes, some of questionable merit.
