The Saudi Center for Commercial Arbitration (SCCA) and Jus Mundi are delighted to announce the beginning of an international partnership to make non-confidential SCCA arbitration materials freely available to the world for the benefit of the public good.
The partnership is the first of its kind in the MENA region, prioritizing confidentiality at all times while enhancing transparency where possible. In turn, the users of arbitration benefit and understand more about arbitration in the region.
Jus Mundi will host select SCCA non-confidential arbitration materials and information publicly, making materials searchable to the global public through Jus Mundi’s advanced AI-based platform and research tools.
Discussing the partnership, Dr. Hamed Merah, CEO of SCCA, stated:
“We at the SCCA are pleased to sign this agreement as SCCA is one of the leading institutions in the region and the ADR icon in KSA. This agreement comes in line with achieving SCCA’s goals to improve the ADR environment in KSA and the region through awareness efforts and spreading best practices reinforcing principles of transparency in a way that brings together our commitment to confidentiality of users and increases the level of predictability and sustainability of the industry.”
He also added:
“Through making more data available on arbitration and ADR in KSA and the region at Jus Mundi’s platform, SCCA increases the knowledge of international industry standards and its experts on the SCCA and KSA and the developments taking place in the region in general.”
Jean-Rémi de Maistre, CEO of Jus Mundi, said:

The partnership will see select SCCA materials and information hosted on Jus Mundi’s comprehensive international law and arbitration database.

أعلن المركز السعودي للتحكيم التجاري عن إبرام شراكة دولية مع منصة “جَسْ ماندي – Jus Mundi” بهدف إتاحة مواد المركز المعرفية غير السرية بالمجان أمام الباحثين والممارسين القانونيين وعموم المجتمع القانوني.
وجرى توقيع الاتفاقية بين المركز و”جَسْ ماندي – Jus Mundi” في المنتدى الدولي الثاني للمركز في دبي، الذي عقد يوم الخميس الماضي ضمن فعاليات “أسبوع دبي للتحكيم 2022″، وبشراكة مع عشرة مكاتب محاماة كبرى، ومشاركة من 18 متحدثًا دوليًّا، وحضور رفيع المستوى من قيادات صناعة التحكيم وقطاعات الأعمال والمستشارين القانونيين والمحامين.
وتُعَد “جس ماندي – Jus Mundi” قاعدة بيانات تسعى إلى إتاحة المعرفة القانونية أمام الجميع، اعتمادًا على ما تمتلكه من برمجيات حديثة معتمدة على تكنولوجيا الذكاء الاصطناعي.
وتنص الاتفاقية على أن تنشر منصة “جَسْ ماندي – Jus Mundi” مواد ومعلومات مختارة ليست سرية بشأن التحكيم يملكها المركز، وفهرستها في قاعدة بيانات “جَسْ ماندي – Jus Mundi” لتكون متاحة للبحث أمام مستخدمي المنصة التي تعتمد على تكنولوجيا الذكاء الاصطناعي والأدوات البحثية المتقدمة.
وتُعَد هذه الاتفاقية هي الأولى من نوعها في منطقة الشرق الأوسط وشمال أفريقيا، ومن شأن إبرامها أن يسهم في رفع الوعي بواقع صناعة التحكيم في المنطقة وتعزيز الشفافية بشأنه أمام مستخدمي التحكيم وبدائل تسوية المنازعات الأخرى، مع المحافظة على عنصر السرية في هذا الصدد.
وفي معرض تعليقه على هذه الشراكة، عَبّر سعادة الرئيس التنفيذي للمركز، الدكتور حامد بن حسن ميرة، عن سعادة المركز بإبرام هذه الشراكة النوعية مع “جَسْ ماندي – Jus Mundi”، التي تأتي في سياق تحقيق مستهدفات المركز بشأن تطوير بيئة التحكيم في السعودية وكامل المنطقة، من خلال جهود بث الوعي، ونشر أفضل الممارسات وتعزيز الشفافية؛ بالشكل الذي يجمع بين التزامنا بالمحافظة على سرية بيانات المستخدمين، وبين رفع درجة التوقُّع واستقرار الممارسة”.
وأضاف سعادة الرئيس التنفيذي للمركز: “إن توفير المركز لمزيد من البيانات حول ممارسات التحكيم وبدائل تسوية المنازعات في المملكة وعموم المنطقة على “جَسْ ماندي – Jus Mundi”؛ سيزيد من معرفة الصناعة الدولية المتخصصة وخبرائها حول العالم بمدى التقدم وريادية المركز والمملكة، والتقدم المُحرَز في عموم المنطقة”.
من جهته، أكد سعادة الرئيس التنفيذي لـ “جَسْ ماندي – Jus Mundi”، الأستاذ جان ريمي دي مايستر، أن منطقة الشرق الأوسط وشمال أفريقيا أصبحت منطقة جاذبة للتحكيم التجاري الدولي، في الوقت الذي يطمح فيه عموم مستخدمي التحكيم إلى الإلمام بواقع الصناعة في المنطقة، وهو ما دفع “جَسْ ماندي – Jus Mundi” إلى إبرام تعاونها مع المركز السعودي للتحكيم التجاري.
وأضاف الأستاذ مايستر: “شراكتنا مع المركز ستحَسّن الفهم العالمي للتحكيم الدولي عند المحامين، والطلاب، وعموم الناس، وتدعم اللجوء إلى التحكيم في هذه المنطقة الصاعدة والحيوية من العالم”.
